TERMS AND CONDITIONS

1 Common 

These are the general terms and conditions for the use of Profincomm internet sites (hereinafter referred to as “Service”) (hereinafter referred to as “Terms”). The user of the Service (hereinafter the “User”) should read these Terms carefully before using the Service. The terms apply to all user actions in the Service. 

The Service may also contain special terms and conditions regarding some functions (such as online store contract terms, review function contract terms) that apply to the User’s functions in addition to these Terms, if the User uses the functions in question. 

2. Rights and restrictions regarding the use of the service 

The user has the right to view and browse the service and its content, such as text, product information, images, trademarks and logos (hereinafter “Content”) and to use the services offered by Profincomm’s service. The user may not modify or reproduce the Content in any way, nor partially distribute, distribute, transfer, publicly present or otherwise make the Content public as such or modified, with the exception of permitted linking according to section 6. 

Profincomm grants the User the limited right to use the Service defined in these Terms and Conditions only for the User’s personal use and the User may not use the Service or Content for commercial purposes. Profincomm does not grant the user any other rights to the Service or Content than the rights separately mentioned in these Terms. 

It is permitted to use the Service only in accordance with the Terms and Conditions in force at any given time and applicable legislation, as well as any instructions and conditions given separately in the Service. The User may not interrupt or attempt to interrupt or otherwise disrupt or attempt to disrupt the operation of the Service in any way. 

The User may not use the Service (i) for illegal activities; (ii) for activities whose purpose is to interrupt the operation of the Service, make it difficult for other users to use the Service or otherwise disrupt the operation of the Service (e.g. placing timed interference programs, Viruses or other material containing parts capable of affecting the programmatic structure of the Service in the Service); (iii) to collect or store personal information of other users; (iv) falsification or manipulation of title or identification data in an attempt to conceal the origin of the content transmitted through the Service; (v) to act as a representative of Profincomm or another party or; (vi) any other form of misrepresentation. 

The user may not send, deliver or publish any such content in the Service (including, but not limited to, texts, images, logos and signs) that is (i) contrary to the law or good practice or otherwise unsuitable for publication, (ii) the rights of third parties offensive or (iii) unlawfully promoting some products or services. 

The user may only send, deliver or publish content in the Service to which he has an unrestricted right to use, including the right to forward the content to Profincomm and allow Profincomm to publish the content in question in the Service in whole or in part without the obligation to pay compensation or other responsibilities. The user undertakes not to submit any claims to Profincomm based on the content sent, delivered or published by the user in the Service. 

The user releases Profincomm and the companies belonging to the same group with it at any given time, as well as all their representatives, managers and employees, from liability in relation to all claims that arise from the user’s use of the Service or are based on the content sent or forwarded by the user in the Service. Profincomm does not check the content sent or transmitted by the user to the Service and is not responsible for it. Profincomm reserves the right at any time based on its own discretion and without prior notice to delete the content sent by the user to the Service and used there. 

Profincomm has the right at any time to limit the use of the Service or its parts or functions, and for justified reasons to block the User’s access to the Service. Profincomm can exercise the rights mentioned without prior notification and liability for compensation. Profincomm also reserves the right to invoke all its legal rights arising from the violation of the restrictions defined in these Terms. 

3. Processing of personal data 

Profincomm processes personal data in the manner permitted and required by the personal data legislation in force at any given time, acting as the registrar of personal records. Customer data is processed as described in the customer register’s register statement.

4. Cookies 

Cookies can be delivered to the user’s terminal device. A cookie is a small text file that can be used to collect information about how and when the Service is used, i.e. for example when and which pages of the Service the User has browsed, which browser the User uses and where the User came to the Service from. The information obtained with the help of cookies is anonymous in nature, but it is possible to connect the information obtained with the help of cookies to the personal information received from the User. 

The purpose of using cookies is to analyze and develop the Service so that it serves the Users even better, as well as to use the information in the statistical monitoring of the number of visitors to the Service and in different measurement of the efficiency of the Service’s functions. Information collected with the help of cookies can also be used to produce targeted advertising. The user has the option to turn off the use of cookies in their browser settings, but this has an effect on the possibilities of using the Service by weakening it or even blocking it completely.

5. Intellectual property rights 

The Service and Content are the property of Profincomm or its partners, protected by copyright laws and international copyright treaties. All intellectual property rights related to the Service and Content (including copyright, registered and unregistered trademark and model rights, domain names, patents, database rights and trade secrets) belong to Profincomm or its partners. All rights reserved.

6. Links to or in the Service 

Users can add links to the Service on their own websites. The link must not contain Profincomm trademarks in graphic form. The link must open in an independent browser window and not in the linking site’s own frame. The appearance, placement and other features of the link must not create the false impression that the linking entity or its functions, services or products are related to Profincomm’s operations or are sponsored by Profincomm. 

Profincomm reserves the right, based on its sole discretion, at any time and without the obligation to provide reasons, to prohibit linking to its Service. 

The service may contain links to websites owned and maintained by third parties. Profincomm does not monitor or check the content of the linked sites and is not responsible for the content, correctness, reliability or data security of the linked sites. The inclusion of links in the Service also does not indicate anything that Profincomm in any way endorses or advertises the services of the linked site or anything else about the relationship between Profincomm and the linked site. Linked sites are not part of the Service and are in no way under the control of Profincomm. The User understands and accepts that using the links removes the User from the Service and that the User uses the linked sites at his own risk. The user should carefully familiarize himself with the terms of use of the linked site and any other instructions before starting to use the linked site.

7. Limitations of liability 

Profincomm provides the Service and Content “as is” without any guarantees. Profincomm is not responsible for the uninterrupted, error-free and timely availability, functionality and usability of the Service. Profincomm is also not responsible for the correctness, reliability, errors, omissions, inaccuracies or other defects of the Content or information displayed in the Service, provided or transmitted through the Service, nor for the non-infringement of rights. 

Profincomm does not give any guarantees about the protection of the Service or that the electronic bulletins sent through the Service do not contain viruses or other harmful parts. Profincomm cannot guarantee the data security of data sent through the Service. Profincomm is not responsible for the information sent or received by the User or not sent or received. 

Profincomm is not responsible for any direct, indirect, direct or indirect damages or special damages based on tort liability (including, for example, damages resulting from loss of business, contract, income or data or business interruption) resulting from using or preventing use of the Service or Content or these Terms , regardless of whether the damages are based on contract, tort, negligence or other basis, even if Profincomm has been informed in advance of the possibility of such damages.

8. Changes 

Profincomm reserves the right to change these Terms at its discretion. Changes to the terms come into effect when the changes are announced in the Service, after which they are applied to the User’s activities in the Service. 

Profincomm reserves the right at any time without prior notice to make changes and corrections to the Service or Content and to disable any parts or functions of the Service.

9. Applicable Law 

These Terms are governed by Finnish law, with the exception of its conflict of law provisions. The parties will primarily try to resolve disagreements arising from these Terms or their application through negotiations. If the negotiations do not lead to an amicable solution, the disagreements will be resolved in Finland at the Helsinki district court. The consumer user can also take the dispute to the district court or consumer dispute board of his domicile.
